Kesha is not backing down and more than ready to continue fighting her legal battle against Dr. Luke.
Despite being ordered to pay a sum of $374,000 to the music producer as part of a broader ruling against her in court for defamation, the Tik Tok singer is reportedly refusing to pay up! According to court documents obtained by The Blast, Kesha is adamant about changing the judge’s decision in favor of the producer, real name Lukasz Gottwald, and has officially filed an appeal.
In the docs, she is specifically asking the higher court to look at their case and reverse the lower court’s order. The latter is referring to when Manhattan Supreme Court Justice Jennifer Schecter had previously ruled the 33-year-old singer defamed Gottwald by sending that infamous 2016 text message to Lady GaGa, in which she asserted he had raped fellow singer Katy Perry.
At the time, Judge Schecter ruled against Kesha, writing in summary (below):
“ Kesha made a false statement to Lady Gaga about Gottwald that was defamatory per se. There is no evidence whatsoever that raped Katy Perry. Moreover, publication of a false statement to even one person, here Lady Gaga, is sufficient to impose liability.”
In the newly submitted docs for her appeal, Kesha is seeking a “reversal of the Order granting in part Plaintiffs’ Motion for partial summary judgment because Plaintiffs are not entitled to judgment as a matter of law (i) that Kesha is liable for allegedly defamatory statements. Made by Mark Geragos and Sunshine Sachs, (ii) that Kesha made a false statement to Lady Gaga that constitutes a defamatory publication per se.”
It’ll be an uphill battle fighting the 46-year-old producer’s legal team who previously told ET in a statement they were hell-bent on getting justice for their client:
“Dr. Luke is pursuing this lawsuit to seek recovery for the serious harm Kesha’s false accusations of rape have caused Dr. Luke, his family and his business. Today’s important decision by the Court in Dr. Luke’s lawsuit brings him closer to the justice that he seeks. First, the Court has now ruled that Kesha made a false and defamatory accusation about Dr. Luke when she baselessly claimed that he raped Katy Perry. Second, the Court rejected Kesha’s attempts to invoke legal technicalities to avoid responsibility for her statements. And third, the Court also correctly held that Kesha breached her contract with Dr. Luke’s company. Dr. Luke looks forward to the trial of his case where he will prove that Kesha’s other false statements about him were equally false and defamatory.”
It’s hard to tell if the court will ultimately reverse their decision in Kesha’s favor, considering she has already suffered more than few legal setbacks. In addition to the defamation suit, there’s also the matter of the star’s allegations that her former producer had sexually assaulted her. Even with the help of an emotional deposition from GaGa in court, in which the singer said she believed Kesha, Dr. Luke’s lawyers called B.S. and insist on clearing his alleged good name.
