Judge Lewis A. Kaplan ruled on Tuesday that he will decide in the next 48 hours whether to grant Cloister Café a temporary restraining order against the State Liquor Authority for shutting the NYC hot spot.
Venue owners say the SLA allegedly violated due process when they shut the venue two weeks ago claiming they violated COVID-19 rules.
Cloister’s lawyer Robert Garson argued the SLA “relied on … a Gothamist” article to shut them down and that it was unconstitutional.
Assistant attorney general James Cooney said the SLA was “mystified” as to why they were in federal court.
