A dad-of-two claims his "botched" NHS hip operation cost him his marriage.
Kenny Hall says the faulty procedure left one of his bones at a 45-degree angle from his leg.
The 54-year-old says the blunder caused years of agony and left him requiring more painful surgery as a result, the Daily Record reports.
Mr Hall claims he has tried to sue the NHS since it happened in 2011 but is unable to progress the legal action because they say they have lost his records.
The dad from Penicuik, Midlothian, Scotland, said: “The hip replacement hasn’t just caused me physical pain, it’s caused me mental and emotional distress too. I’ve been in pain since 2011 – it was fitted wrongly and I’ve needed more surgery as a result.”
Mr Hall was given the all-clear after the op by a surgeon but claims the hip had, in fact, been inserted incorrectly at the outset.
He believes X-rays taken at the BMI Woodlands hospital in Darlington at the time would prove his case. But he says efforts to recover them have proved fruitless as the NHS claims they’re missing.
Mr Hall said: “Because of the surgery, I walked with a squint and the pain and issues put a lot of strain on my marriage.
"It ended us. I’m trying to take action against the health board because when I had my replacement replaced in Edinburgh Royal Infirmary in 2016, the surgeon said he had never seen anything like it before. He said it was fitted 45 degrees incorrectly.
“I lived down in the Borders at the time and had the choice of Borders General in Galashiels or Darlington. I picked Darlington because it’s a private hospital – I thought it would be quicker.
“I have solicitors on the case now but we’re struggling as the only case we have is malpractice by the NHS. Believe it or not, there’s not much of a claim now because the pre and post-op X-rays from 2011 have disappeared.
“The manager at the X-ray department told me the X-rays were signed out and never went back.”
